An Abrupt Ending to the Fairytale: Annulment
First Comes Love, then a Fast Marriage, then….Annulment?
Legal Separation and Annulment are two seldom used legal procedures for the termination of a marriage, yet I receive numerous calls and questions from people about the topic. (The process of legal separation is discussed in another article.) Annulment is rarely used because it can only be used to terminate a marriage in very specific situations. The reasons allowed are as follows:
- One of the parties is under the legal marriage age (18 years old for men, and 16 years old for women);
- One spouse is already married to another person;
- One party is adjudicated a mentally incompetent;
- One party obtained consent through fraud or by force; and
- Where the marriage was never consummated.
If one of the above matches your legal situation, then this type of marriage cancellation may be the correct avenue for ending your marriage. If not, than you will likely need to use one of the other procedures of legal separation, dissolution, or divorce.
