Many times in divorce the parties have been living separately for some time.  Many times parties are already engaged to a new significant other, and are living with that person.  Finally, the parties file for divorce and are ready to move on and be officially be done with each other.  Then the wife reveals she is pregnant – her attorney does not seem happy…Why?

Under the law, any child conceived during the time of the marriage is presumed to be the child of the husband.  It does not matter how long you have been living apart, or that you have not “known” each other in the biblical sense for many years.  The law does not care, and the court will not spend time litigating any of those issues.  In a divorce, if the wife becomes pregnant before the divorce is finalized, the divorce proceedings come to a halt until the baby is born.  Once the baby is born, a paternity test can be performed, and the divorce can proceed.

If you are living with a new man, but are contemplating divorce, take steps to prevent pregnancy.  If you really want to be done with your ex, make sure you do not do anything to halt the process.
